Come join us for Part One of our Four-Part series. Planning for Your Future - New York City-based estate planning and elder law series with attorney Lorese Phillips. Each session is $15  for members.


Part 1 -   The Basics of Estate Planning
Should you consult an estate planning attorney or an elder law attorney, or just turn to online software to create documents?

In her first presentation, Attorney Phillips will address:
  • What is an “estate”, what is meant by “estate planning”, and who needs to think about this? Also, what questions should you ask yourself to get started.
  • Do you need a Will and what does that document do?
  • What happens if you don’t have one? What information should be included in a Will?
  • Are there requirements for a valid Will, and what if your Will falls short?
  • What is a “trust” and how does or could a trust work within your estate plan?
  • Can a trust replace a Will? Who may need a trust, and how does a trust work? (Note that part-two in this series will focus exclusively on “Understanding Trusts” and will go into much greater depth on this subject.)
  • What about Beneficiary Designations?
  • Can you just use one more Beneficiary Designations and/or “pay on death” or “transfer of death” designations and not have a Will or trust?
  • When is it best to use a Beneficiary Designation, and when not to use those designations?

These questions and much more will be addressed in Ms. Phillips’ first presentation. You will also receive the The Basics of Estate Planning PowerPoint to use as a resource.

Lorese Phillips

Lorese Phillips is an attorney in private practice in New York City with over twenty-nine years of experience in all aspects of trusts and estates, Elder Law, representing persons with disabilities and residential real estate transactions. Her practice includes preparing Last Wills, trusts, and advanced directives, and counseling clients on estate planning, tax planning, long-term care, asset protection planning, and eligibility for government benefits. Ms. Phillips also represents clients in probate proceedings, trust and estate administration matters, and residential real estate transfers.

Ms. Phillips has been annually recognized by Best Lawyers in America in Elder Law since 2022, and her firm has been ranked as a Tier 1 Best Law Firm in Elder Law by Best Lawyers in America. She has also been selected to Super Lawyers since 2023. She is an active member of the New York State Bar Association, where she currently serves on the Executive Committee of the Elder Law and Special Needs Section and Co-Chairs its Estates, Trusts, and Tax Issues Committee. In addition, she is an active member of the NYSBA Trusts & Estates Law and Real Property Law Sections. Ms. Phillips has been a long-time member of the New York City Bar Association and a current member of the National Academy of Elder Law Attorneys (NAELA). 

Ms. Phillips also serves on the Board of Directors of a not-for-profit organization that addresses the needs of seniors in and around New York County.

Ms. Phillips has lectured before the New York State Bar and the New York City Bar Associations, the Practicing Law Institute, the Dickinson School of Law at Penn State University, as well as to local New York City senior groups. She has a B.A. from SUNY Stony Brook (Phi Beta Kappa), an M.F.A. from Columbia University School of the Arts (Sculpture), and a J.D. from the Benjamin N. Cardozo School of Law.
